Release of Liability – Read Carefully, This Affects Your Legal Rights

In consideration for access to and use of the facilities, equipment, and services provided by Hype Sports LLC, I, the undersigned adult member, agree to the following terms on behalf of myself:

1. Agreement to Follow Rules

I agree to observe and obey all posted rules, safety guidelines, and instructions given by Hype Sports LLC staff, employees, or representatives.

2. Assumption of Risk & Release

I understand that physical training, gym use, athletic activities, cold plunge, sauna, and tanning bed sessions involve inherent risks including but not limited to injury, illness, burns, hypothermia, heat exhaustion, dehydration, fainting, muscle strain, or death.
I voluntarily accept full responsibility for any injuries or damages I may suffer and hereby release Hype Sports LLC from any liability, regardless of cause, including negligence.

3. Cold Plunge Acknowledgment

I understand the cold plunge exposes the body to extreme cold temperatures which may cause: shock, dizziness, numbness, breathing difficulty, increased heart rate, and loss of consciousness.
I confirm I do not have any medical condition that would make cold exposure unsafe (ex: heart disease, Raynaud’s, high blood pressure, respiratory illness, diabetes complications). I accept full responsibility for my participation.

4. Sauna Acknowledgment

I understand that sauna use involves prolonged heat exposure which may cause: dehydration, heat exhaustion, fainting, dizziness, or cardiovascular complications.
I confirm I am medically able to safely use sauna equipment and will not use the sauna under the influence of drugs, alcohol, or if pregnant without medical clearance.

5. Tanning Bed Acknowledgment & Medical Warning

I understand tanning bed use involves UV radiation exposure which can cause sunburn, skin damage, premature aging, eye injury, and increases the risk of skin cancer.
Maximum tanning bed usage in this facility is 15 minutes per 24-hour period.

I confirm I am not currently taking any medications or using products that increase photosensitivity, including but not limited to:

  I accept responsibility for checking with my physician or pharmacist before tanning if I am unsure about any medication or health condition.

6. Indemnification

I agree to indemnify and hold harmless Hype Sports LLC from all claims, actions, damages, costs, or expenses (including attorney fees) arising from my participation or presence on the premises.

7. Damages

I accept financial responsibility for any damage to property or equipment caused by my negligent, reckless, or intentional actions.

8. Term of Agreement

This agreement is valid for one (1) year from the date signed. Early cancellation of any membership or contract is subject to a 50% fee of the remaining balance.

9. Late Payment Policy

Payments received more than 5 days past due will incur a $10 late fee. Continued non-payment may result in suspension of access until the account is current.

10. Consent to Participate

I confirm that I am voluntarily participating in physical activity and facility services and have the legal capacity to agree to these terms.

11. Medical Authorization

In case of emergency, I authorize Hype Sports LLC to seek medical treatment on my behalf. I assume all related financial responsibility.

12. Applicable Law

This agreement is governed by the laws of the State of Georgia.

13. No Duress

I acknowledge I am not under duress, have had the opportunity to review this agreement, and may seek legal counsel before signing.

14. Arm’s Length Agreement

This agreement is a product of mutual negotiation. No interpretation shall be made “against” either party as the drafter.

15. Enforceability

If any section is deemed unenforceable, the remaining provisions shall remain in effect.

16. Dispute Resolution

Any dispute will first be addressed through good-faith negotiation, then mediation, and if unresolved, binding arbitration under the American Arbitration Association.

17. 24/7 Key Fob Access

• Key Fob Return: All key fobs must be returned upon cancellation. Failure to return will result in a $25 fee.

• Lost/Stolen Fob: Replacement fobs incur a $10 charge, due immediately.

18. Rope Climbing Acknowledgment

I understand rope climbing involves risks (falls, burns, impact, serious injury) and accept full responsibility.

19. Media Release

I grant Hype Sports LLC permission to use photos, videos, or statements of me for marketing, promotion, or publication without compensation.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. BY SIGNING BELOW, I VOLUNTARILY WAIVE CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.
